Let’s talk about wills and estates

client

I am too young to have a Will.

ENSLINS

WRONG!

Any person who is 16 years and older can have a will.

CLIENT

I have drawn up a will 10 years ago so I’m fine – Right?

ENSLINS

WRONG!

It is best to review your will annually

CLIENT

My wife and I got married a week ago – We don’t need a will.

ENSLINS

WRONG!

Now you seriously need a will – Both of you!

VERY IMPORTANT: What is more – prior to the wedding you should have made sure that both of you understood the different marriage dispensations namely:

  • In community of property
  • Out of community of property
  • With accrual
  • Without accrual

If you did not sign an Ante nuptial Contract prior to your wedding you will be deemed to have been married In Community of Property.

CLIENT

I don’t have enough assets to draw up a will.

ENSLINS

Well, let’s see if that is true. Just answer the following questions with a YES or NO

  • Do you have a car or other movable assets?
  • Do you own a property?
  • Do you own a fire arm?
  • Are you married?
  • Do you have children or other dependents?

If you answered YES to any of the questions then it is best to draw up a Will – ASAP.

The fact is

A will is probably one of the most important documents you will ever sign in your life.

CLIENT

Where do I start?

ENSLINS

First determine if you have all the answers to the following questions.

  • Do you know how much estate duty your estate will have to pay?
  • Do you know if your estate has enough cash to cover all potential costs or expenditure?
  • Do you know if the cash in your estate is enough to provide for your family after your death?
  • Do you know if the cash in your estate is enough to enable your loved ones to maintain their current lifestyle after your death?

If you don’t have the answers to these questions you will have to agree that you seriously need professional help to assist you with these questions.
